1. ABOUT THE HIVE MEDIA

THE HIVE MEDIA ("we", "us", "our", "the Platform") is an online portfolio and creative networking platform operated from Ontario, Canada. It connects creative professionals — photographers, videographers, graphic designers, content creators, and media producers — with clients and collaborators across Canada and internationally. We do not sell, trade, or monetise any user data.

2. ACCEPTANCE OF TERMS

By accessing or using THE HIVE MEDIA, you confirm that you are at least 18 years of age, have read and understood these Terms of Service, and agree to be legally bound by them, along with our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Platform.

3. ELIGIBILITY

You must be at least 18 years of age to create an account on THE HIVE MEDIA. By registering, you confirm that you meet this requirement and that all information you provide is accurate and truthful.

4. CREATOR ACCOUNTS

By uploading content to THE HIVE MEDIA, you confirm that:

• You own all intellectual property rights in the content, or hold a valid licence to share it publicly.
• The content does not violate any applicable Canadian law, provincial law, or third-party rights.
• You grant THE HIVE MEDIA a non-exclusive, royalty-free, worldwide licence to display your portfolio on the Platform for the purpose of connecting you with clients.
• You retain full ownership of your work at all times and may remove it at any time via your dashboard.

5. CLIENT ACCOUNTS

Clients register on THE HIVE MEDIA to discover and contact creative professionals. By creating a client account, you agree to:

• Use creator contact information solely for legitimate hiring or collaboration purposes.
• Not send unsolicited commercial messages (spam) to creators, in compliance with Canada's Anti-Spam Legislation (CASL).
• Not engage in fraudulent, misleading, or abusive hiring practices.

6. PROHIBITED CONDUCT

You agree not to:

• Post content that is unlawful, defamatory, obscene, harassing, or infringes any third-party intellectual property rights.
• Impersonate another person, business, or entity.
• Scrape, copy, hack, or reverse-engineer any part of the Platform.
• Use the Platform to send spam or unsolicited commercial communications, in violation of CASL.
• Upload or distribute malicious code, viruses, or any harmful software.
• Attempt to gain unauthorised access to any account or system.

7. INTELLECTUAL PROPERTY

All platform design, branding, code, and original content (excluding user-uploaded portfolio work) is the exclusive property of THE HIVE MEDIA and is protected under Canadian copyright law. You may not copy, reproduce, redistribute, or create derivative works from Platform materials without prior written permission.

8. PAYMENTS & FEES

THE HIVE MEDIA is currently free to use for both creators and clients. If paid features or subscription tiers are introduced in the future, registered users will be notified in advance by email, and fresh consent will be obtained before any charges are applied.

9. DISCLAIMER OF WARRANTIES

THE HIVE MEDIA is a discovery and networking platform only. All commercial arrangements, contracts, and payments between creators and clients are solely between those parties. THE HIVE MEDIA is not a party to any such agreements and accepts no liability for disputes, non-payment, or damages arising from creator-client arrangements. The Platform is provided "as is" without warranties of any kind, express or implied.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable Canadian law, THE HIVE MEDIA, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform — including but not limited to loss of data, loss of revenue, or loss of business opportunity.

11. TERMINATION

We reserve the right to suspend or permanently terminate any account that violates these Terms, without prior notice. You may delete your account at any time from your dashboard settings. Upon termination, your public profile will be removed from the Platform.

12. CHANGES TO THESE TERMS

We may update these Terms of Service from time to time. Where changes are material, we will notify registered users by email at least 14 days before the changes take effect. Your continued use of the Platform after that date constitutes acceptance of the updated Terms.

13. GOVERNING LAW & DISPUTE RESOLUTION

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada. If you are located outside Canada, you agree to submit to this jurisdiction for any dispute related to your use of the Platform.

Our Promise: THE HIVE MEDIA does not sell, rent, or share your personal data with any third party for commercial or marketing purposes — ever. This Privacy Policy complies with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.

1. WHO WE ARE

THE HIVE MEDIA is an online portfolio and creative networking platform operated from Ontario, Canada. We connect photographers, videographers, graphic designers, content creators, and media producers with clients across Canada and internationally.

2. INFORMATION WE COLLECT

Account Information: Name, email address, and password (stored encrypted via Firebase Authentication). We collect only what is necessary to provide the service.

Profile Information: Bio, city, service category, social links, studio name, and contact phone — only what you voluntarily add to your public profile.

Portfolio Content: Photos and videos you upload are stored securely via Cloudinary. You retain full ownership of all uploaded content.

Contact Form Data: Name, email, phone, and message submitted via our Contact page are stored in our secure database and forwarded to our team email for response purposes only.

Usage Data: Anonymised, non-identifiable data on page visits and feature interactions, used solely to improve the Platform.

Cookies: Essential and functional cookies only. No advertising or tracking cookies. See our Cookie Policy for full details.

3. LEGAL BASIS & HOW WE USE YOUR INFORMATION

Under PIPEDA, we collect and use personal information only with your knowledge and consent, or as otherwise permitted by law. We use your information to:

• Create and maintain your account on the Platform.
• Display your public profile and portfolio to visitors and potential clients.
• Send transactional emails (account verification, password reset) via Firebase and our custom domain noreply@idyllicstudios.ca.
• Respond to contact form submissions sent to our team.
• Improve Platform features using anonymised analytics.
• Comply with applicable Canadian legal obligations.

We do not use your data for advertising, profiling, or sell it to any third party.

4. THIRD-PARTY SERVICES

We use the following trusted third-party services to operate the Platform. Each is bound by its own privacy policy:

• Firebase (Google) — Authentication, database, and transactional email. Privacy Policy ↗

• Web3Forms — Contact form email forwarding. No data is retained by Web3Forms beyond delivery. Privacy Policy ↗
• Google Fonts — UI typography only; no personal user data is shared.

All third-party providers used by THE HIVE MEDIA are required to handle personal data in accordance with applicable privacy laws.

5. DATA RETENTION

Your personal data is retained for as long as your account remains active. If you delete your account, your personal data will be permanently removed from our active systems within 30 days. Contact form submissions are retained for up to 12 months for customer service purposes, then deleted.

6. YOUR RIGHTS UNDER PIPEDA

As a Canadian resident (or user of a Canadian platform), you have the following rights regarding your personal information:

• Access — Request a copy of the personal data we hold about you.
• Correction — Update or correct your information at any time via your profile settings or by contacting us.
• Withdrawal of Consent — Withdraw consent for data processing at any time (note: this may affect your ability to use the Platform).
• Deletion — Request deletion of your account and all associated personal data.
• Complaint — Lodge a complaint with the Office of the Privacy Commissioner of Canada (OPC) at priv.gc.ca ↗ if you believe your privacy rights have been violated.

7. SECURITY

We implement appropriate technical and organisational safeguards to protect your personal data, including: Firebase encrypted authentication, HTTPS-only data transmission, and Cloudinary's secured media infrastructure. In the event of a data breach that poses a real risk of significant harm, we will notify affected users and the Office of the Privacy Commissioner as required by PIPEDA.

8. CHILDREN'S PRIVACY

THE HIVE MEDIA is not intended for users under 18 years of age. We do not knowingly collect personal data from minors. If we become aware that a minor has created an account, we will delete the account and associated data promptly.

9. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. Where changes are material, registered users will be notified by email at least 14 days before the changes take effect. The "Last Updated" date at the top of this page will always reflect the most recent revision.

None of these third-party cookies are used for advertising or marketing purposes.

4. YOUR CONSENT

When you first visit THE HIVE MEDIA, you will be shown a cookie consent banner. By clicking "Accept", you consent to our use of functional cookies as described above. Essential cookies are strictly necessary for the Platform to function and do not require consent under applicable Canadian law.
